Terms of Service

1. Acceptance of Terms

By accessing or using the Casta platform — including the mobile application and website (collectively, the "Service") — you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

Casta is a two-sided marketplace that connects talents (models, actors, and creative professionals) with companies (production houses, casting agencies, and event management firms) in Saudi Arabia and the GCC region. Casta facilitates discovery, booking, contract signing, attendance tracking, and related services. Casta is not a party to agreements between talents and companies — it provides the platform for such agreements.

3. User Accounts

3.1 Account Types

The Service supports two primary account types: Talent accounts (for individual creatives) and Company accounts (for organisations posting casting calls). Each account type is subject to a verification process before full access is granted.

3.2 Accuracy

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. Impersonation or false profiles are grounds for immediate account suspension.

3.3 Credentials

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4. Company Obligations

• Post casting projects that are genuine, lawful, and accurately described.
• Honour commitments made to talents through the platform, including agreed compensation and project dates.
• Provide required business documentation (Commercial Registration, Zakat Certificate) for account verification.
• Not circumvent the platform to contact or hire talent sourced through Casta outside of the platform's agreement systems.
• Comply with Saudi labour law, data protection regulations, and applicable industry standards.

5. Talent Obligations

• Maintain an accurate and up-to-date profile, including photos, physical attributes, and skills.
• Attend booked projects on time and in the agreed capacity. Repeated no-shows may result in account suspension.
• Grant location access when using the GPS check-in feature for on-set timesheet verification.
• Not share account access or allow others to apply to projects on your behalf.
• Behave professionally in all interactions facilitated through the platform.

6. Subscription & Billing

6.1 Plans

Company accounts may subscribe to paid tiers (Pro at $49/month, Enterprise at $199/month) for access to additional features. A free tier is available with limited functionality as described on the Pricing page.

6.2 Billing

Subscriptions are billed monthly or annually in advance. Prices are in USD unless a SAR billing arrangement has been agreed. All fees are exclusive of applicable taxes.

6.3 Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Casta does not offer pro-rata refunds for unused periods except where required by applicable law.

6.4 Plan Changes

Upgrades take effect immediately and are prorated. Downgrades take effect at the next billing cycle.

7. Intellectual Property

You retain ownership of content you upload to the platform (portfolio images, videos, project briefs). By uploading content, you grant Casta a non-exclusive, royalty-free licence to display that content within the Service for the purpose of operating the platform. Casta's brand, software, and platform design are protected by copyright and may not be reproduced without written permission.

8. Prohibited Conduct

• Posting false, misleading, or discriminatory casting calls.
• Harassing, threatening, or exploiting other users.
• Attempting to reverse-engineer, scrape, or copy the platform.
• Using the platform for any illegal purpose under Saudi law or applicable regulations.
• Creating multiple accounts to evade a suspension or circumvent plan limits.

9. Limitation of Liability

To the maximum extent permitted by law, Casta and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Casta's total liability for any claim arising from these Terms shall not exceed the amount you paid to Casta in the three months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Saudi Arabia.

11. Changes to Terms

Casta may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
